General Court of the Court of Justice of the EU invalids Rubik’s cube three-dimensional trade mark

With a judgement delivered on the 24th October 2019, the eighth chamber of the General Court has declared the three-dimensional trade mark of the world-famous cube puzzle invalid pursuant to Article 7(1)(e)(ii) of Regulation No 40/94, under which signs consisting exclusively of the shape of goods which is necessary to obtain a technical result are not to be registered.
