State Aids in the National Jurisprudence

The recent “modernisation” of the state aid framework has decentralized the enforcement of the legislation in this area. In particular, under the General Block Exemption Regulation, some aid schemes do not require prior “scrutiny” by the European Commission, while national courts play an increasing role in the private enforcement of state aid law. The Center aims to deepen the analysis of the application of the law on state aids in the aftermath of their “modernization”, identifying a series of emerging trends at national level and in the EU legal system. In particular, the aim is to carry out an in-depth survey at European level of how state aid legislation is implemented (i.e. interpreted and decided) by national courts, both ordinary and special. The final goal, in the context of possible partnerships with scholars and expert professionals in the sector, both Italian and foreign, would be the creation of a database that allows an overall and global perspective of the topic.
